Main Terms of Use
The following clauses form a legally binding agreement between you
and MyAppz.
These terms apply to visitors, users, subscribers, and any business
entity interacting with our digital properties or services.
If your organization signs a separate written agreement with MyAppz,
that written agreement controls in case of conflict for the covered
services.
1
Acceptance of Terms
By accessing this website, creating an account, requesting a
proposal, purchasing services, or otherwise using MyAppz, you
confirm that you have read, understood, and agree to these Terms
& Conditions.
-
If you are accepting these terms on behalf of a company,
partnership, or other legal entity, you represent that you have
authority to bind that entity.
-
You must be at least the age of majority in your jurisdiction
to use paid services independently.
-
If you do not agree with any term, your sole remedy is to stop
using the website and services.
-
Continued use after an update to these terms constitutes
acceptance of the revised terms unless local law requires
additional consent.
2
Services and Availability
MyAppz provides digital services that may include strategy,
software implementation, optimization work, and ongoing support.
Service scope is defined by your selected plan, statement of work,
invoice, or proposal.
-
We may improve, modify, suspend, or discontinue specific
features at any time to maintain security, performance, or legal
compliance.
-
We make reasonable efforts to maintain uptime; however, service
interruptions can occur due to maintenance, infrastructure
changes, force majeure events, or third-party dependencies.
-
We reserve the right to decline service where requested use
violates law, infringes rights, or creates a material risk to
platform security.
-
Estimated timelines are good-faith projections and may shift due
to project complexity, delayed approvals, missing assets, or
external constraints.
-
Beta, preview, or trial features may be offered “as available”
and can be changed or removed without prior notice.
3
User Responsibilities and Acceptable Use
You are responsible for your account behavior, project inputs,
legal permissions for supplied materials, and compliance with
applicable laws and regulations.
-
You must provide accurate and current account, contact, and
billing information.
-
You must keep credentials confidential and notify us promptly if
you suspect unauthorized access.
-
You may not use our services to transmit malware, perform
unauthorized scanning, abuse APIs, or circumvent security
controls.
-
You may not upload, publish, or request creation of unlawful,
defamatory, infringing, exploitative, or otherwise prohibited
content.
-
You may not reverse engineer, scrape at scale, or otherwise
attempt to extract proprietary system logic beyond permitted use.
-
You agree to cooperate with reasonable requests needed to deliver
services, including timely approvals, content submissions, and
technical access when required.
-
Delays caused by incomplete inputs or delayed approvals may
impact launch dates and support windows.
4
Fees, Billing, and Payments
Paid services require payment according to the pricing terms
presented at checkout, in your order form, or in an approved
proposal.
Unless stated otherwise, all fees are in the billed currency and
exclude applicable taxes.
-
You authorize MyAppz and its payment processors to charge the
selected payment method for all due amounts.
-
Subscription plans, where applicable, renew automatically at the
end of each billing cycle until canceled according to the
cancellation terms.
-
One-time project fees, milestone invoices, or setup charges are
payable on the schedule stated in your agreement.
-
Late or failed payments may result in service suspension,
throttled access, delayed deliverables, or cancellation.
-
Except where required by law, fees are non-refundable once
services have commenced or deliverables have been provided.
-
You are responsible for any bank, foreign exchange, transfer, or
transaction fees associated with payment.
-
Chargebacks filed without first contacting us to resolve billing
concerns may be treated as a breach of these terms.
-
We may revise pricing for future billing periods with reasonable
notice as required by law or contract.
5
Intellectual Property Rights
All rights, title, and interest in MyAppz software, methods,
templates, branding, graphics, documentation, and proprietary
materials remain with MyAppz or its licensors unless expressly
transferred in writing.
-
You retain ownership of content and assets you lawfully provide
to us for project execution.
-
You grant us a limited, non-exclusive license to host, process,
and use your materials solely to provide services and support.
-
Deliverables may include third-party components subject to
separate licenses, terms, or attribution requirements.
-
Unless restricted by NDA or contract, MyAppz may reference your
company name and approved project outcomes in portfolio and case
study materials.
-
You may not remove proprietary notices, trademarks, or copyright
statements embedded in software or documentation without consent.
-
No right is granted to reproduce, resell, sublicense, or create
derivative systems from our proprietary platform except as
expressly permitted.
6
Disclaimers and Limitation of Liability
To the maximum extent allowed by applicable law, services are
provided on an “as is” and “as available” basis without warranties
of uninterrupted operation, merchantability, fitness for a
particular purpose, or non-infringement.
-
MyAppz is not liable for indirect, incidental, consequential,
punitive, exemplary, or special damages, including lost profits,
lost data, lost business opportunities, or reputational harm.
-
We are not responsible for failures caused by third-party
providers, hosting platforms, payment networks, browser changes,
API deprecations, or force majeure events.
-
You are responsible for maintaining backups of your own data and
materials unless backup obligations are explicitly included in
your service agreement.
-
In jurisdictions where liability limitations are permitted, our
total aggregate liability is limited to the amounts paid by you
to MyAppz for the service directly related to the claim during
the prior three months.
-
Some jurisdictions do not allow certain exclusions or limits, so
portions of this clause may not apply in full to you.
7
Suspension and Termination
We may suspend or terminate access immediately if there is a
material breach of these terms, non-payment, misuse of services,
legal risk, or a threat to platform security or other users.
-
You may stop using services at any time, subject to any minimum
commitment period and outstanding payment obligations.
-
On termination, rights granted under these terms cease
immediately except clauses that by nature survive termination.
-
Surviving clauses include payment obligations, confidentiality,
ownership, disclaimers, limitations of liability, and governing
law provisions.
-
We may delete or anonymize account data after reasonable retention
periods, except where law requires longer retention.
-
Reactivation after suspension is at MyAppz discretion and may
require remediation steps, updated verification, or fee settlement.
8
General Legal Provisions
This section clarifies additional legal rules that support and
interpret the full agreement.
-
If any provision of these terms is held unenforceable, the
remaining provisions remain valid and enforceable.
-
Failure by either party to enforce any right is not a waiver of
future enforcement of that or any other right.
-
You may not assign or transfer your rights under these terms
without prior written consent, except where permitted by law.
-
MyAppz may assign this agreement to an affiliate or successor in
connection with a merger, acquisition, or business transfer.
-
These terms, together with any referenced policies and written
service agreements, constitute the entire agreement between you
and MyAppz regarding the covered services.
